These terms and conditions of use of the site ("Terms of Use") govern your use of the site hosted at the internet address https://www.million-italy.it, including all sections and areas thereof dedicated and reserved for registered users, such as the Returns Center section ("Site"). The Site is operated by MILLION CORPORATION SRL, VAT number 10467441217, with headquarters at Via Traversa Michelangelo, 14 - 80026 Casoria, registered with the Chamber of Commerce of Naples with REA NA - 1108078 (hereinafter, "Million", "we", "our", "us").

Welcoming you to our Site, we invite you to read these Terms of Use carefully before continuing to access or use the Site. These Terms of Use apply to all visitors and/or users of the Site. By accessing or using the Site, you confirm your acceptance of these Terms of Use and express your willingness to be bound by them. If you do not agree to and/or accept these Terms of Use, you may not use this Site and we therefore ask you to cease using it immediately.

• INFORMATION FOR CONSUMER

The Products displayed on the Site are offered for sale to anyone acting for reasons unrelated to their commercial, artisanal, entrepreneurial, or professional activity. The purchase of products on the Site is permitted only to individuals aged 18 or over, or under 18 with the consent and supervision of a parent or guardian. The Products offered for sale on the Site can be purchased and shipped only to the countries listed on the Site.

Before confirming and submitting the purchase order, the Consumer must carefully read these Conditions of Sale. They can also be viewed and downloaded from the Site. These Conditions of Use, together with the Privacy Policy and the Conditions of Sale , contain the rules governing the contract between the Consumer and Million for the purchase of Products through the Site.

• PROCESSING OF YOUR PERSONAL DATA

To allow you to use or access certain sections or features of the Site, including dedicated areas reserved for registered users, we may ask you to provide us with certain personal data about you. The processing of personal data you provide to Million through the Site is fully described in our Privacy Policy and the Privacy Policies available on the site. To learn about our practices and privacy policy, we invite you to consult the Privacy Policy and Privacy Policies. By using the Site, you acknowledge and agree that communications over the Internet are never completely confidential or secure, and you understand that any information or message you send to the Site may be read or intercepted by persons other than the intended recipients, even if there are notices indicating that a particular transmission is encrypted (for example, the transmission of credit card information).

• MILLION BRAND

The terms "Site" and "Material" mean, respectively and by way of example and not limited to, the software, the implementation and use of the Site, the layout, structure and organization of the contents of the Site, as well as any Material reproduced therein and/or made available to the public, including, in particular, the collection and organization of data and information, photographs, images, illustrations, texts, video clips, musical compositions, audio clips, designs, distinctive signs, logos, trademarks, distinctive elements defined as trade dress or any other Material reproduced and/or made available through the Site (”Materials”).

The Materials on the Site, in whole or in part, including, but not limited to, trademarks, domain names, designs and models, patents, and copyrights, are protected and owned by Vincenzo De Martino and Vincenzo Laudiero, both partners of MILLION CORPORATION SRL, the company that owns the website www.million-italy.it. All rights thereto, internationally, are reserved.

All trademarks, trade names, logos, designs, and other distinctive signs reproduced on the Site, even if unregistered, are trademarks or service marks of Vincenzo De Martino and Vincenzo Laudiero. All domain names used on the Site and/or connected to it belong to, or are authorized by, Million, which manages them internationally.

The Site is intended for private, personal, and non-commercial use; the Material presented on the Site is for informational and/or promotional purposes only.

You may not, in any form and/or by any means and for any purpose, even in part, carry out any of the following operations involving the Site, any Materials on the Site, or the related software: reproduce (except for reproduction for personal, non-commercial use), publish, disclose, transmit, make available to the public, republish, distribute, display, remove, delete, add to, or otherwise modify, create and/or use derivative works or works in any way inspired by, sell, or participate in any sale.
Downloading or copying, unless authorized in writing by Million, does not grant you any right, title, or interest in the Materials or software.

Million is committed to preserving, enforcing, and protecting its intellectual property rights worldwide and to vigorously combating any infringement thereof to ensure that its valuable assets are securely protected and fully respected. Any use not expressly permitted under these Terms of Use is prohibited. Million's failure to seek any remedy, whether judicial or extrajudicial, does not in any way constitute tacit consent or tolerance of any violation of the Site's Terms of Use and/or of Million's intellectual property rights.

• REGISTRATION AND SUBSCRIPTION TO SERVICES

Registration and subscription to the Services

The User may register or subscribe to Million's Services available from time to time on the Site.
When registering or subscribing to the Services, the User is required to provide accurate and truthful information. The User agrees to promptly inform Million of any changes to the information provided at the time of registration or subscription. This is to ensure that the User receives messages sent by Million and prevents such messages from being mistakenly transmitted to third parties.

If the User is registered for a Service that requires prior authentication (for example, an Account or Wish List), the User agrees to immediately notify Million if they suspect unauthorized access to their account or that their password has been compromised. Responsibility for use of their account rests solely with the User, provided that such use is attributable to them or results from their failure to adopt adequate password protection measures.

Without prejudice to any other remedy provided by applicable law and the Terms of Use, in the event of a violation by the User of the provisions contained in the Terms of Use, Million shall have the right to cancel the User's registration or subscription, block the User's account and/or deny, limit, suspend or revoke the User's access to the Site and the Services.

• APPLICABLE LAW

These Terms of Use are governed by Italian law and shall be interpreted in accordance with the same.

These Terms of Use constitute the entire agreement between you and Million relating to the subject matter hereof.

The offer and sale of products on www.million-italy.it are governed by these Conditions of Sale, together with the Conditions of Use , the Return Policy and the Privacy Policy .

• GENERAL CONDITIONS

These general conditions of sale (hereinafter, the "General Conditions") govern all sales of Million products (hereinafter, the "Products" or "Product") concluded remotely on the website www.million-italy.it (hereinafter, the "Site").

The distance selling service governed by the General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or "Clients"); 'consumers' means natural persons over the age of 18 who are acting for purposes outside of their commercial, entrepreneurial, artisanal, or professional activity.

Customers are required to carefully read the General Conditions, available on the Site, in order to familiarize themselves with them, save them, and reproduce them. Contracts concluded with Customers will be archived by Million for the period required by applicable law.

• MILLION PRODUCT ORDERS

Orders can be placed directly by adults or minors with parental supervision.
Orders can be placed on the website www.million-italy.it, or through Million Customer Service, available every day from 8:00 am to 8:00 pm.
The Customer is required to provide Million with a valid email address to which the requested information, the information required by these General Conditions of Sale, and any order information will be sent. Each distance selling order placed by the Customer under these General Conditions of Sale may concern one or more products, up to a maximum of seven products per order, of which a maximum of two units per item.
Million reserves the right to modify at any time the limits on the quantity and/or types of products that can be purchased through distance selling.
The Customer is responsible for selecting the items of interest. The Customer's shopping cart and the order summary sent to the Customer following completion of the purchase include a description of the products ordered, including measurements and dimensions (where applicable), and a digital photograph that accurately represents the products available on the site.
Million takes all appropriate measures to ensure that the photographs on the site faithfully represent the original products, including technological means to minimize inaccuracies. However, some variations are possible due to the technical characteristics of the customer's computer and color resolution. Consequently, any confirmation of a product's condition is subject to the limitation of any inaccurate representation on the customer's computer.
The Customer must click on the cart icon to view the selected items and the total price of the ordered items. The Customer is invited to check the contents of the cart before completing the purchase form according to the instructions provided on the website, and to confirm that they have read and accepted these General Conditions of Sale. If the Customer needs to change (an item or quantity) or correct any errors in the order, they must follow the instructions on the Website.

• PRICES

The price of the Products listed on the Site is expressed in Euros or Dollars, depending on the country you are browsing from, and includes all applicable taxes or duties. Any delivery costs, which will be indicated separately on the order form, if applicable, must be added to the price of the Products.

Million constantly verifies the accuracy of the prices listed on the Site; however, it cannot guarantee the absence of errors. If an error is discovered in the price of a Product, Million will reject the order and offer the Customer the opportunity to purchase the Product at the correct price. If the error is discovered only after the order has been accepted, Million will offer the Customer the option to cancel the order.

• PAYMENT

To pay the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated on the order form.

Payment by Card

For payment by credit card (Visa, Mastercard, American Express), the amount will be charged to the Customer's credit card when the order is prepared for shipping.
To prevent online fraud, payments made via the website www.million-italy.it are handled online by the bank in question using tools provided by Stripe.

PayPal

Payment for products purchased on the website www.million-italy.it can be made via PayPal. If the Customer chooses PayPal as the payment method, they will be redirected to the PayPal website where they can pay for the products according to the procedure established and regulated by PayPal and the contractual terms and conditions agreed between the user and PayPal. The data entered on the PayPal website will be processed directly by PayPal; therefore, they will not be sent to Million or shared. Million therefore does not have knowledge of, and cannot in any way record, the details of the credit card linked to the Customer's PayPal account or any other payment instrument linked to that account.
For payments via PayPal, the total amount due will be charged by PayPal to the Customer upon completion of the online contract. In the event of termination of the purchase contract or any other type of refund, for any reason, the refund will be credited to the Customer's PayPal account. The time required to credit the payment method linked to that account depends solely on PayPal and the banking system. Once the credit order has been placed to that account, Million cannot be held responsible for any delays or omissions in crediting the Customer with the refund. To dispute such cases, the Customer must contact PayPal directly.

Cash on Delivery

For those who don't have credit or prepaid cards, the Million website offers customers the cash on delivery option (valid for Italy only), which allows them to pay cash upon delivery. This payment method has a €3 fee, which is displayed during the order process. Please note that the courier is required to leave the package only after receiving the full cash on delivery fee and cannot allow customers to try on the items or open the package.

Payment in 3 installments with Scalapay

Million offers the option to pay for any order in three installments thanks to a contract signed with Scalapay. The first installment is paid immediately upon ordering, the second installment 30 days later, and the third and final installment 60 days later. If you purchase with Scalapay, you receive your order immediately and pay in three installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related parties, and their assignees, and that you authorize such assignment.

• TRANSPORT AND DELIVERY

The Customer acknowledges and accepts that:

1. Ordered items will be delivered to the residential or business address provided by the customer at the time of ordering; the customer cannot redirect packages or prevent courier drivers from redirecting deliveries if the recipients are not at home;
2. If the delivery address is located in a building with a reception/concierge service, delivery will be considered complete when the reception/concierge service receives the package from the courier. Therefore, ownership of the goods will pass to the Customer upon delivery to the reception/concierge service.

• RIGHT OF WITHDRAWAL

Pursuant to Article 52 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, within 14 (fourteen) days from the date on which the Customer (or his/her representative for receipt of the Products) physically takes possession of the Products or, in the case of split deliveries, from the day on which the Customer physically takes possession of the last Product. For hygiene/health reasons, all products that come into contact with intimate parts of the body, such as underwear and socks, are in all cases excluded from the right of return and the right of withdrawal.
To learn the specific methods by which you can withdraw from the contract, please refer to the Return Policy section. Please pay attention to the information in this section because the information contained therein forms an integral and substantial part of these Conditions of Sale and, therefore, is deemed to be fully understood and accepted by you at the time of submitting the order form.

• WHAT IF I REFUSE THE SHIPMENT?

If you refuse your order upon delivery and wish to be refunded, you should be aware that the cost of both the outward and return shipping will be deducted from your total.

• GUARANTEE OF AUTHENTICITY

Million guarantees the authenticity of all Products purchased on the Site. Products branded "Million" are made with Italian materials, are packaged by Italian artisans and are all strictly and entirely MADE IN ITALY, with the sole exception of some leather goods, such as backpacks and clutches, which are made in the EU, in particular they are imported from France.

• APPLICABLE LAW AND POSSIBLE CHANGES

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code, with specific reference to the legislation on distance contracts, and by Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.
The Conditions of Sale are amended from time to time also in consideration of any regulatory changes.

INFORMATION FOR ORDERS FROM DECEMBER 8, 2023 TO DECEMBER 20, 2023

During the Christmas holidays, all orders received during this period will have an extended return period, in fact, returns can be made until January 6th. Our standard return policies will reapply to items purchased starting December 21, 2023.
